The contracting party is the provider named in the booking confirmation, quotation or invoice.

2. Formation of the contract

The presentation of services, prices and offers on our websites does not, as a rule, constitute a binding contractual offer.

A contract is formed when we confirm a booking or order, or when an offered service is ordered on a binding basis through an online booking or payment system.

For services paid for directly online, the contract is formed no later than successful payment confirmation.

Individual quotations and written agreements take precedence where they expressly provide for different conditions.

3. Prices and payment

The applicable prices are those shown in the relevant quotation, booking system or checkout at the time of booking or ordering.

The tax information shown forms part of the quotation or invoice.

Depending on the offer, different payment methods are available, in particular:

  • Card payment
  • Stripe
  • Bank transfer
  • Other offered payment methods

For payments through Stripe, payment and card details are processed directly by Stripe. S3PS does not store complete credit card details.

Provision of a service or activation may be conditional on successful payment.

4. Appointments and studio services

Confirmed appointments for studio, photography, film, video or other production services are binding.

The customer is responsible for arriving on time for the agreed appointment and providing required files, texts, music, templates or other materials in good time.

Late arrival by the customer may reduce the available production time accordingly.

Rescheduling and cancellation are subject to the conditions communicated with the relevant offer, booking or order confirmation.

Statutory rights remain unaffected.

5. Customer cooperation and rights to supplied content

The customer ensures that all content supplied by them may be used lawfully.

This applies in particular to:

  • Music
  • Texts
  • Images
  • Videos
  • Logos
  • Brands
  • Voice recordings
  • Beats
  • Samples
  • Other protected content

The customer is responsible for obtaining any necessary consents, permissions and usage rights.

6. Copyright and usage rights

Copyright remains with the respective rights holder.

For photographs, audio recordings, videos, films, graphics or other works produced by us, the customer receives usage rights to the extent agreed in the relevant order or quotation.

More extensive, exclusive or transferable usage rights apply only where expressly agreed.

Use of work results may be withheld until the agreed remuneration has been paid in full.

7. Editing, corrections and acceptance

For services such as mixing, mastering, retouching, video editing or similar creative work, the scope of included corrections is determined by the relevant offer.

Additional requested changes outside the agreed scope may be charged separately.

Obvious errors or discrepancies should be reported as soon as possible after receipt of the service.

8. S3PS HOTSPOT

The S3PS HOTSPOT provides time-limited internet access.

Available plans, durations and prices are displayed in the Hotspot portal before booking.

As a rule, a booking applies to the device used to order access.

The booked usage period begins when internet access is successfully activated.

Access ends automatically when the booked usage period expires.

There is no automatic renewal unless expressly stated otherwise for the relevant plan.

A new booking is required for further use.

Prohibited use

The following are prohibited in particular:

  • Unlawful acts
  • Attacks on third-party systems or networks
  • Distribution of malware
  • Unauthorised access to third-party data
  • Unlawful distribution of copyrighted content
  • Other abusive use or use that endangers security

In the event of misuse or a threat to the technical infrastructure, access may be restricted or blocked to the extent necessary.

Uninterrupted availability of Wi-Fi or internet access cannot be guaranteed at all times. In particular, radio interference, maintenance, technical faults, provider outages or third-party disruptions may occur.

If a Hotspot service was demonstrably paid for but could not be provided because of a technical fault, statutory claims remain unaffected.

9. Payment processing for S3PS HOTSPOT

Online payments for S3PS HOTSPOT are processed through Stripe.

The user is redirected to a payment page provided by Stripe.

Card details are not entered or stored on our servers.

Internet access is activated only after successful payment confirmation.

Incomplete or cancelled payment transactions do not entitle the user to use paid internet access.

10. Technical requirements

To use our online offerings and S3PS HOTSPOT, the customer or user needs a suitable device.

We do not guarantee that every older or specially configured device is compatible with all offered functions.

Technical safeguards, network segmentation, access controls and security filters must not be circumvented.

11. Liability

We are liable without limitation for intent and gross negligence and for injury to life, body or health.

In the event of a slightly negligent breach of essential contractual obligations, liability is limited to foreseeable damage typical of the contract.

Mandatory statutory liability provisions remain unaffected.

The customer should retain their own backup copies of data and files supplied by them.

12. Right of withdrawal

The statutory provisions on the right of withdrawal apply to consumers.

Where a statutory right of withdrawal exists for a particular service, the consumer receives the information required by law.

If the consumer expressly requests that a service begin before a possible withdrawal period expires, the statutory provisions apply.

Statutory exceptions to the right of withdrawal remain unaffected.

13. Data protection

Information on the processing of personal data is available in our Privacy Policy:

Privacy Policy

The privacy information of the respective payment or booking service provider also applies where its services are used.

14. Consumer dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration body, unless there is a statutory obligation.

15. Changes to these terms

We may amend these General Terms and Conditions for future contracts where required by legal, technical or organisational changes.

As a rule, contracts already concluded remain subject to the terms applicable when the contract was formed.

16. Final provisions

The law of the Federal Republic of Germany applies, taking mandatory consumer protection provisions into account.

For consumers, mandatory statutory provisions of the country in which they habitually reside remain unaffected.

If an individual provision of these General Terms and Conditions is or becomes invalid, the remaining provisions remain unaffected.
